General Terms and Conditions (GTC)

1. Scope

(1) These General Terms and Conditions (GTC) apply to all orders placed via the online shop www.solmae.de.

(2) The offer is directed at both consumers and businesses.

(3) A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their self-employed professional activity.

(4) An entrepreneur is a natural or legal person or a legal partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

3. Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.

(2) By clicking the button “Order with obligation to pay,” you submit a binding order for the goods contained in the shopping cart.

(3) The contract is concluded as soon as we accept your order by sending an order confirmation via email or by dispatching the goods.

4. Prices and Shipping Costs

(1) All prices are stated in euros and include the applicable statutory VAT.

(2) In addition to the stated prices, shipping costs may apply. These are shown separately during the ordering process.

5. Delivery

(1) Delivery is available worldwide.

(2) The delivery time is specified in the respective offer.

(3) If an ordered product is not available, we reserve the right not to deliver. In this case, you will be informed immediately and any payments already made will be refunded.

6. Payment

(1) The following payment methods are generally available in our shop:

  • PayPal

(2) Your account will be charged immediately after completion of the order.

7. Retention of Title

The goods remain our property until full payment has been made.

For entrepreneurs, the following also applies:
We retain ownership of the goods until all claims arising from an ongoing business relationship have been fully settled.

8. Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal.

9. Warranty (Liability for Defects)

(1) The statutory warranty rights apply.

(2) For entrepreneurs, the warranty period for delivered goods is one year from the transfer of risk.

(3) In relation to entrepreneurs, only the manufacturer’s product description shall generally be deemed agreed as the quality of the goods.

10. Liability

(1) We are fully liable for damages resulting from injury to life, body, or health.

(2) For other damages, we are only liable in cases of intent or gross negligence.

(3) In cases of simple negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations).

(4) Liability is limited to the foreseeable damage typical for the contract.

11. Contract Language

The language available for the conclusion of the contract is German.

12. Storage of Contract Text

The contract text is not stored by us permanently.

You will receive the order details and these GTC via email.

13. Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.

14. Place of Jurisdiction

For merchants, legal entities under public law, or special funds under public law, the place of jurisdiction is Berlin.

15. Final Provisions

Should individual provisions of these GTC be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
